HomeMy WebLinkAbout2022-063 Parkland Storage Annexation Agreement RESOLUTION NO. 2022-063 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA, APPROVING THE ATTACHED ANNEXATION AGREEMENT BETWEEN THE CITY OF PARKLAND AND PARKLAND STORAGE, LLC CONCERNING THE 3.83 ACRE PARCEL OF LAND LOCATED ON THE SOUTH SIDE OF LOXAHATCHEE ROAD APPROXIMATELY 3/4 OF A MILE WEST OF PARKSIDE DRIVE; AUTHORIZING EXECUTION OF THE ANNEXATION AGREEMENT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Parkland Storage, LLC ("Parkland Storage") owns an approximately 3.83 acre parcel of land presently located in unincorporated Broward County, Florida ("County") and contiguous to the City of Parkland, as more particularly described in Exhibit"A"(the"Property"); and WHEREAS, Parkland Storage submitted an annexation petition meeting all statutory requirements on September 7, 2022, and a copy of the petition is on file with the City Clerk; and WHEREAS,the City Commission hereby determines it to be in the interest of the health, safety,and welfare of the citizens and residents of the City of Parkland to enter into an Annexation Agreement with Parkland to set forth the general parameters of the expectations and limitations that will govern any future development of the Property; and WHEREAS, the proposed Annexation Agreement, attached as Exhibit"1", embodies the terms agreed upon by the parties. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA AS FOLLOWS: Section 1. The above referenced "Whereas" clauses are true and correct and made a part of this Resolution. Section 2. The City Commission hereby approves the Annexation Agreement, attached as Exhibit "1", together with such non-substantial changes as are acceptable to the City Manager and approved as to form and legal sufficiency by the City Attorney. Section 3. The appropriate City officials are hereby authorized and directed to execute the necessary documents to effectuate the purpose and intent of this Resolution upon receipt of a title opinion and other documentation evidencing proper authority to bind the Property. Section 4. All resolutions, or parts of resolutions, in conflict with this Resolution are repealed to the extent of such conflict. Section 5. Should any section,provision or word of this Resolution be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder of this Resolution other than the part declared to be invalid.
