1999-52 Site Plan Approval Parkland Shops & Office Centre RESOLUTION 99 - 52 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA FOR SITE PLAN APPROVAL OF THE PARKLAND SHOPS AND OFFICE CENTRE, LOCATED NORTH OF HOLMBERG ROAD ON THE EAST SIDE OF PARKSIDE DRIVE: CASE NO. 01-SP-99. WHEREAS, at a regular meeting of the City Commission a Quasi-Judicial Public Hearing was held to hear testimony for and against the petition of Transeastem Properties, Inc. requesting site plan approval of the Parkland Shops and Office Centre Project containing 35,200 square feet of retaill office development; and . WHEREAS, the City Commission of the City of Parkland has heard information from the petitioner's representatives, staff and the public; and WHEREAS, the City Commission has found that the proposed development is consistent with the Comprehensive Plan; and WHEREAS, the City Commission has found that the proposed development meets all applicable concurrency requirements; and WHEREAS, the City Commission has found that the proposed development meets all applicable codes and ordinances of the City of Parkland; and WHEREAS, the proposed site plan has been reviewed by the Planning and Zoning Board which voted 5 - 2 for APPROVAL; and WHEREAS, the proposed uspecial exceptionu use for a child care center was reviewed by the Planning and Zoning Board which voted 7 - 0 for DENIAL. NOW, THEREFORE, be it resolved by the City Commission of the City of Parkland, Florida, that; The Parkland Shops and Office Centre site plan is approved with the following conditions: 1. This approval is based on the site plans entitled; "Parkland Shops and Office Centre" prepared by Marc Wiener, A.I.A. Architecture I Planning dated received by the Planning Department on October 12, 1999 containing two (2) sheets. Plans prepared by AJ Hydro Engineering for infrastn1cture improvements containing two (2) sheets and a tree survey prepared by Craven-Thompson & Associates, Inc. dated received by the Planning Department on September 17, 1999. 2. This approval is also based on a landscaping plan prepared by Dave Booker, landscape Architect & Planning, Inc. dated received September 22, 1999 by the Planning Department containing two (2) sheets. Also included is a traffic analysis prepared by Hughes Hall Inc. dated received on September 20, 1999 by the RESOLUTION 99-52 PAGE 2 Planning Department and a Photometric Values (lighting) site plan prepared by Y oungross, Cardenal & Associates Consulting Engineers, Inc. dated received by the Planning Department on November 24, 1999 containing two (2) sheets. 3. The petitioner shall be allowed to put one (I) free standing identification sign in confonnance with the approved site plan. 4. The petitioner shall be required to maintain fifteen (15) foot oflandscaping around all buildings. 5. The petitioner shall contribute $30,000 to the City of Parkland prior to the issuance of a building pennit and an additional $5,000 per year on the anniversary date of the issuance of building pemiit for four (4) years for a total of $50,000 to be put in a fund for the improvements and maintenance for the intersection of Parkside Drive and Holmberg Road. The $20,000 dollars shall be secured by an agreement or bond acceptable to the City Attorney. 6. The petitioner shall construct the concrete wall along the eastern buffer area after site grating and prior to construction of any buildings. 7. All leases shall contain a condition requiring tenants to maintain all common property in a manner consistent with the approved site plan, elevations, and other graphic representations. 8. The petitioner shall, prior to the issuance of a building permit, enter into an agreement in a fonn acceptable to Cypresshead Club Inc. or its successors and assigns to pay on a per acreage basis its fair share of maintenance for the Parkland Lakes PUD drainage system. 9. Petitioner shall comply with all the conditions listed in the memo dated October 7, 1999 from the City Engineer, except for condition # 2 in that memo. 10. The petitioner shall provide full screening of parking areas by the placement of a hedge at least forty-eight inches (48") in height at time of platting and shall be maintained at a minimum of seven (7) feet in height to be reached in three (3) years at the two entrance/exit areas adjacent to the parallel parking spaces which are parallel to Parkside Drive. 11. The petitioner has agreed to comply with all sign code and ordinance regulations of the City of Parkland. 12. The petitioner has agreed that all tenants shall comply with the City of Parkland recycling requirements and to place such a provision in all leases. 13.
