A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF PARKLAND, FLORIDA URGING THE
BROWARD COUNTY ZONING BOARD AND BROWARD
COUNTY COMMISSION TO DENY REZONING
PETITION 14-Z-99 AND THE ACCOMPANYING SITE
PLAN FOR SAID PROPERTY LOCATED IN
UNINCORPORATED BROWARD COUNTY ADJACENT
TO THE CITY OF PARKLAND.
WHEREAS, East Marsh nurseries has submitted rezoning petition 14-Z-99 for a rezoning
from Agricultural (AI) to Plan Development District for a 50.988 acre parcel, which property is
located adjacent to the municipal boundaries of the City of Parkland; and
WHEREAS, said Petition also contains an accompanying site plan for 132 single family
homes; and
WHEREAS, said Petition has been amended by the applicant to contain an accompanying
site plan for 113 zero-lot line homes; and
WHEREAS, the City of Parkland believes that the rezoning petition and site plan to permit
such a dense development would be contrary to the best interests of the citizens of Broward County
and the citizens of Parkland; and
WHEREAS, the City Commission of the City of Parkland believes that the proposed
development would require placement of lakes under Florida Power and Light power lines in order
to permit clustering of density on available land and that such a development scheme would be
contrary to the desires of Florida Power and Light and would also provide for an overly dense
development of homes; and
WHEREAS, the City of Parkland City Commission believes that the absence of a county
fire station within four (4) miles of the proposed development is contrary to good planning principles
followed by Broward County; and
WHEREAS, although the property is not within the City of Parkland, it is surrounded by
municipal boundaries of the City of Parkland and said development would not conform to the
development requirements of the City of Parkland; and
WHEREAS, the proposed development would clearly be marketed towards families, thus
adding a significant number of school age children to the population in an area where there is already
serious overcrowding of schools;

NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF PARKLAND, AS FOLLOWS:
Section 1. The City Commission of the City of Parkland does hereby strongly urge that
the Broward County Zoning Board and the Broward County Commission deny rezoning 14-Z-99
from Agricultural (A-I) to Planned Develop'ment District (PDD) and to deny the accompanying site
plan for the reasons as set forth above.

A prospective developer is looking to purchase a portion of the East Marsh
Nursery located in Unincorporated Broward County. This developer has petitioned the
county to rezone the subject property to a Planned Development District (PDD) to allow
for flexibility in zoning setbacks and density. The subject rezoning includes a large
portion of the FPL easements as well as the future right-of-way for Hillsboro Boulevard
to connect to Parkside Drive.
Please find attached the questions raised by Staff and the Elected Officials
related to this issue. At the Commissioners request, the City Attorney has drafted a
resolution which will be presented to the county. The Broward County Zoning Board is
scheduled to hear this application on Wednesday, August 11, 1999 at 7:00 p.m. in the
County Commission chambers in downtown Fort Lauderdale. The petitioner requested
postponement until the October 13. 1999 meeting.
A revised site plan has been submitted to the County. A preliminary review of
this site plan shows a more acceptable development pattern, but does not address all
of the prior issues.
At this time there are still unresolved issues and Staff is recommending that the
City Commission adopt the Resolution opposing the proposed rezoning until these
issues are resolved by the developer.
