HomeMy WebLinkAbout1999-10 Special Assessment Trotters Lane Paving DROPPED - NEVER BROUGHT BACK TO COMMISSION RESOLUTION NO. 99-10 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PARKLAND EVIDENCING ITS INTENT TO PROVIDE FOR A MAJOR PUBLIC IMPROVEMENT PROJECT, LOCATED IN THE AREA GENERALLY KNOWN AS THE RANCHES, ALL INCLUSIVE IN THE CITY OF PARKLAND, BEING ROADWAY IMPROVEMENTS ON NW 72ND STREET (TROTTERS LANE), SERVING CERTAIN LOTS WITHIN THE RANCHES AND ESTABLISHING THE COSTS AND EXPENSES THEREOF; PROVIDING FOR ALL COSTS AND EXPENSES TO BE ASSESSED AGAINST THE PROPERTIES ON AN ACREAGE BASIS; PROVIDING FOR PAYMENT AND TERMS AND THE INTEREST RATE TO BE CHARGED WITH RESPECT TO SUCH ASSESSMENTS; THE PERCENTAGE OF THE ASSESSMENT THAT MUST BE PAID AT THE TIME OF ASSESSMENT AND FOR SEMI- ANNUAL PAYMENTS THEREAFTER; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, there are certain properties located within the City of Parkland comprising the properties within the area indicated in Section I; and . WHEREAS, it is the intent of the City Commission to provide for roadway improvements for lots; and WHEREAS, the lots in question will be specifically benefited by the improvements; and WHEREAS, the City has undertaken the subject improvement and assessment subject to the authority of Chapter 170, Florida Statutes, and its home rule powers through Chapter 166, Florida Statutes. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA: Section 1. That the City Commission does hereby declare the necessity for roadway improvements for all lands to be described in the assessment plat hereinafter provided for and generally located within the areas described as follows: * (Public road rights-ot-ways, public roadway easements, and pUblic roadway ingress and egress easements are excluded) * The Brewer Plat Book 142, Page 10 ot Broward County Record located in Section 3, Township 48, Range 41 within the City ot Parkland, Broward County, Florida. Resolution 99-10 Page 2 * Tract 16 of Florida Fruitlands Co., Subdivision # 2, Plat Book 1, Page 102, Palm Beach County Records in Section 3, Township 48, Range 41 within the City of Parkland, Broward County, Florida. Section 2. The improvements located in the area described in Section 1 above are for the construction of roadways. The general description of the project is as follows: Roadway improvements including the following: * Design and construct approximately 1,130 Linear Feet of roadway and one (1) cul-de-sac at the western limits of the completed Trotter's Lane (NW 72 St) located within the Ranches Community. * Other necessary actions attendant to the above. Section 3. The estimated cost (including administrative, engineering and legal expenses) of the project is $ 34.850. Section 4. That due to the nature of the roadway improvements, all of which are local improvements solely for the special benefit of the lots contained within the area described in Section 1 above; 100 percent of the costs of the above-described project shall be assessed against said lots and lands in the area described in Section I above, said assessments to be made on an acreage basis. Section s. That the assessments when established shall require twenty (20%) percent. of the total lot assessment from the project to be paid within a period of 60 days from the date of final assessment and the balance to be paid in eight (8) regular successive semi-annual payments of the principal and accrued interest, which interest shall be established at eight (8%) percent per annum. Section 6. That all the costs set out in Section 3 for the project described in Section 2 above, shall be in the special assessments which shall be levied against all lots or lands within the city limits of Parkland adjoining and contiguous or bounding and abutting upon such improvements or specially benefitted thereby (as generally described in Section I) and further designated by the assessment plat to be Resolution 99-10 Page 3 hereinafter provided for by the City. The costs of the project described herein shall be assessed at 100% to said lots and properties and no portion shall be paid from the general fund of the City, it being the intent that the entire cost of this improvment be paid for by this special assessment. Section 7. That the City Commission will pass such other resolutions, provide proper notices and take such other steps as may be necessary or required to declare the special assessments, and provide for the equalizing board hearings. Section 8. That this resolution shall be in full force.and effect immediately upon its passage and adoption. PASSED AND ADOPTED TIllS DAY OF . 1999.
