1998-45 Controling Number of Horses per Acre RESOLUTION 98 - 45 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA, DECLARING ZONING IN PROGRESS; PLACING ALL PROPERTY OWNERS ON NOTICE THAT THE CITY COMMISSION OF THE CITY OF PARKLAND WILL BE CONSIDERING ADOPTING AN AMENDMENT TO THE LAND DEVELOPMENT AND ZONING CODE REGULATlNG THE AMOUNT I NUMBER OF HORSES WlDCH MAY BE STABLED ON ANY PROPERTY WITHIN THE CITY, LIMITS; PROVIDING FOR PUBLICATION OF SAID NOTICE OF TmS RESOLUTION BY THE CITY CLERK. WHEREAS, the City Commission of the City of Parkland wishes to consider adopting an ordinance regulating the amount of horses which may be placed on residential or agricultural property; and WHEREAS, this ordinance shall control the amount I number of horses stabled on any property located within the City and shall provide for a maximum number based upon acreage or lot size; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA AS FOLLOWS: Section 1. The City Commission of the City of Parkland hereby places all owners of property within the City of Parkland on notice that it shall be considering within the next one hundred twenty (120) days adoption of an ordinance regulating the amount of horses which may be stabled on any property located within the City of Parkland. Section 2. Any person requesting any permit for stabling or a development or other permit which would have the effect of permitting stabling of horses or creating a horse stable on any property within the City of Parkland shall not be approved except with the caveat that any such approval shall be subject to the regulations imposed by any ordinance adopted by the City of Parkland's City Commission within this one hundred twenty (120) day period. Section 3. All owners of property are hereby placed on notice that any applications which are pending, or which may be submitted as of the date of this ordinance for the purpose of constructing a stable or stabling horses shall be subject to the regulations provided herein. Section 4. The City Staff or Development Review Committee or the City Commission shall review any such application and any approvals there of shall be specifically subject to compliance with any RESOLUTION 98- PAGE 2 ordinance adopted by the City Commission pursuant to this resolution. The City Staff, Development Review Committee, or City Commission, in approving any application for a boarding stable or for stabling horses on property within the City, are hereby authorized to delay the final approval of any such application pending the results of any ordinance adopted during this one hundred twenty (120) day period. This shall not be a moratorium, and any application may be processed, but it shall be processed with the contingency as set forth herein with the requirement that the final approval of said application shall be timed so as to provide for compliance with any ordinances adopted during this one hundred (120) day period.
