THE G.o.oDMAN C.oMPANY; CASE N.o. 04-SP-98. WHEREAS, at a regular meeting of the City Commission a Quasi-Judicial Public Hearing was held to hear testimony for and against the petition of The Goodman Company requesting site plan approval of the Parkland Plaza Project containing over 150,000 square feet of retail! commercial development and three (3) out parcels; and WHEREAS, the City Commission of the City of Parkland has heard information from the petitioner's representatives, staff and the public; and WHEREAS, the City Commission has found that the proposed development is consistent with the Comprehensive Plan; and WHEREAS, the City Commission has found that the proposed development meets all applicable concurrency requirements; and WHEREAS, the City Commission has found that the proposed development meets all applicable codes and ordinances of the City of Parkland; and WHEREAS, the proposed site plan has been reviewed by the Planning and Zoning Board which voted 6 - 0 for DENIAl. NOW, THEREFORE, be it resolved by the City Commission of the City of Parkland, Florida, that; The Parkland Plaza Project site plan is approved with the following conditions: I. This approval is based on the site plan entitled; "Shoppes of Parkland" prepared by Saltz-Michelson Architects dated received by the Planning Department on October 09, 1998 containing six (6) sheets, and also including landscaping plans prepared by Dave Bodker Landscape Architecture containing three (3) sheets, and drainage RESOLUTION 98- 41 PAGE 2 preliminary engineering prepared by Heller, Weaver and Cato, Inc. and a tree survey. 2. That the agreement for filling in the irrigation ditch along the northern property line be signed off by all parties prior to issuance of a building pennit and that construction of filling in the ditch shall be completed prior to a Certificate of Occupancy for any building. 3. All out-parcels shall be required to be reviewed and approved by the City Commission of the City of Parkland and no out-parcel development shall be deemed to be approved, pennitted or in any way vested. The applicant should be aware that the City is considering further development which will apply to these parcels. 4. The proposed site wall along the northern property line shall be installed prior to the issuance of a Certificate of Occupancy for any building on the property. 5. The petitioner shall complete the purchase of the 1.2 acres of City owned property in the northwest corner prior to the issuance of a building pennit. 6. The petitioner shall limit hours of delivery, loading, and unloading on any site to be between 7:00 a.m. and 9:00 p.m. 7. That the applicant satisfactorily meet the criteria set forth in Sections 13-71 through 13-79 of the City Code relative to design and appearance as detennined by the Community Appearance Board. 8. The petitioner prior to the issuance of a building penn it shall provide additional right-of-way or easements to accommodate the three turn lanes into the site area and the adjacent side walks to Broward County as well as additional right-of-way required for additional turn lanes required for turn lanes and sidewalks to Florida Department of Transportation along US 441. 9. The applicant prior to the issuance of a building pennit shall provide a conservation easement around the Cypress preserves identified in out-parcels numbered one and two. 10. The petitioner shall complete an agreement with the City of Coconut Creek to construct a sixteen inch (16") force main and a twelve inch (12") water main along State Road 7. This agreement shall be finalized prior to the issuance of a building pennit and the construction and completion of this infrastructure shall be completed and accepted by the City of Coconut creek prior to the Certificate of Occupancy for any building. 11. The petitioner shall remove the stonn water drainage system proposed next to the Cypress Preserve in out-parcel number one (#1). 12. The petitioner shall provide a recorded copy to the City of Parkland of all easements to be abandoned prior to the issuance of a building pennit.
