RESOLUTION NO. 97-25B
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF PARKLAND, FLORIDA, AUTHORIZING THE
CITY OF PARKLAND TO ENTER INTO AN ADDENDUM
TO THE SEPTEMBER 3, 1997 AGREEMENT BETWEEN
THE CITY OF PARKLAND, WCI COMMUNITIES LIMITED
PARTNERSHIP, AND THE NORTH SPRINGS
IMPROVEMENT DISTRICT
WHEREAS, the City Commission of the City of Parkland has authorized by
Resolution No. 97-25A an addendum to the agreement dated September 3, 1997 between
the City of Parkland, WCI Communities Limited Partnership, and North Springs
Improvement District,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF PARKLAND, FLORIDA:
Section 1. The City of Parkland City Commission does hereby authorize the
Mayor of the City of Parkland to execute an addendum to the agreement dated September
3, 1997 between the City of Parkland, WCI Communities Limited Partnership, and North
Springs Improvement District to reflect an agreement between the City of Parkland and
North Springs Improvement District and interpret the language in 4(A) of said agreement
to apply to cooperation with "all applicable governmental entities."
Section 2. This Resolution shall become effective upon adoption.

a notary and have the Addendum recorded in the public records. Before mailing our original to be
recorded, make a certified copy for our records (in case it gets lost). Please mail one original to WCI
and one to NSID and return an executed ~ to me for my file.

TInS DECLARATION OF RESTRICTIVE COVENANTS (this "Declaration") is
executed this 19th day of December, 1997, by WCI COMMUNITIES LIl\1ITED
PARTNERSHIP, a Delaware Limited Partnership, its successors and assigns (WCI), the
owner of the property attached hereto as Exhibit A, as follows:
WHEREAS, WCI, the City of Parkland (CITY) and the North Springs
Improvement District (DISTRICT) entered into an Agreement dated September 3, 1997
and recorded September 18, 1997 in Official Records Book 27012, at Page 824, of the
Public Records of Broward County, Florida and an Addendum to Agreement recorded on
September 18, 1997 in Official Records Book 27012, at Page 990, of the aforesaid Public
Records (the Agreement and Addendum are hereinafter collectively referred to as "the
Agreement"); and
. WHEREAS, this Declaration is being recorded by wcr pursuant to the Agreement
in order to bind the property described on Exhibit A (the Property) as set forth in the
Agreement and to supplement the enforcement of the obligations imposed in the
Agreement which are and remain valid and binding obligations on the Property to run with
and bind the Property;
WHEREAS, the purpose of this Declaration is to bind wcr, and all future owners
of the Property, to the terms and conditions of the Agreement, and WCI has authority to
execu,te and record this Declaration for said purposes;
NOW THEREFORE, WCI, ON BEHALF OF ITSELF AND ITS SUCCESSORS
AND ASSIGNS DOES HEREBY VOLUNT ARll. Y BIND THE PROPERTY

Section 2. The Agreement is hereby incorporated as part of this Declaration
and all covenants and requirements of the Agreement as specifically set forth therein shall
be binding on WCI, its successors and assigns, the Property, and all future owners of the
Property, as if fully set forth herein. Neither this Declaration nor the Agreement establish
any lien rights in favor of the CITY or the DISTRICT, with respect to the Property.
Section 3. This Declaration is being recorded and shall bind the Property in
order to implement the Agreement, including but not limited to, that provision which
requires that the Property be used only as a landscaped common area for the property
directly to the north thereof, and prohibiting the Property from being used as a road of any
kind or for vehicular traffic of any type or for right-of-way or roadway or ingress and
egress of any kind.
Section 4. This Declaration is executed for the benefit of, and shall be
enforceable by, the CITY or any owners of property immediately adjoining, abutting and
contiguous to the north boundary line of the Property. The provisions of this Declaration
may be enforceable by the CITY or said owners by action in the Circuit Court through an
action for injunction as WCI acknowledges that any violation of this Declaration shall
cause irreparable harm to the CITY. Further, if the CITY or any owners of property
immediately adjoining, abutting and contiguous to the north boundary line of the Property
seek to enforce the Agreement, they shall have available to them injunctive relief and
specific performance. The CITY shall have the right to enforce this Declaration, and the
restrictions contained herein, without the consent or approval of the property owners
immediately adjoining, abutting and contiguous to the north boundary line of the Property
or any other person or entity.

Section 5. Should the CITY be required to take action to enforce this
Declaration, then in that event, should the CITY prevail in any said enforcement
proceeding, it shall have a right to reimbursement from the non-prevailing party for all
attorney's fees and costs, including any attorney's fees or costs of an appeal.

Section 6. Prior to any action to enforce a default under this Declaration, the
CITY or adjoining owner shall give WCI thirty (30) days written notice by mail, delivery
by Federal Express, some other delivery service or hand delivery by a CITY law

The Agreement, and all other Exhibits, remain in full force and effect and are not affected
by this provision.
Section 8. This Declaration shall be recorded. in the Public Records of
Broward County and shall be binding upon WeI, its successors and assigns, the Property,
and all future owners of the Property in perpetuity, and inure to the benefit of the CITY
and the owners of any parcels of property immediately adjoining, abutting and contiguous
to the north boundary line of the Property.
Section 9. These restrictions are hereby declared to be severable and
independent. If any court of competent jurisdiction shall declare any section, paragraph or
part thereof invalid or unenforceable, then such judgment or decree shall have no effect on
the enforcement or validity of any other section, paragraph or part hereof, and the same
shall remain in full force and effect.

WHEREAS, the City Commission of the City of Parkland is processing an
application for rezoning of the 1128.023 acre parcel located north of the City Limits, west
of Nob Hill Road, east of the Conservation Area and south of County Line. The majority of

the subject parcel has. a current zoning of County A-1 and the City of Parkland is
requesting a rezoning to City of Parkland Residential RS-2.5, RS-3, RS-4, RS-6, RM-8 and
City of Parkland A-1 for the parcel; and
WHEREAS, the City Commission of the City of Parkland finds it in the best interest
~f the City to rezone the parcel designated in the attached Exhibit; and
WHEREAS, the Planning and Zoning Board of the City of Parkland has reviewed
said petition as required by Florida Statutes and has made recommendation for approval
by a 6-0 vote of the members present; and
WHEREAS, the City has analyzed the subject parcel at maximum development of
three (3) units to the acre and finds that all regional roadway networks once ultimately
constructed would meet current levels of service; and
WHEREAS, the City and the owner of the property recognizes that the subject
parcel has a County Land Use designation of three (3) units to the acre and the land owner
has voluntarily restricted the parcel to a maximum of three thousand three hundred and
eighty four (3384) dwelling units and is therefore consistent w~h the Broward County Land

Use Plan; and
WHEREAS, the City is treating the subject property as a single parcel with both a
land use and zoning density cap of three thousand three hundred and eighty four (3384)
dwelling units;

WHEREAS, the City Commission of the City of Parkland has held duly advertised
public hearings for the above mentioned petition;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF PARKLAND, FLORIDA AS FOLLOWS:
Section 1. The above referenced findings are true and correct and incorporated
herein.
Section 2. The parcel described on the attached exhibit map and legal description
is hereby rezoned from County A-1 to the Residential Zoning categories as follows, and
not withstanding anything contained on the zoning map shall be limited to three thousand
three hundred and eighty four (3384) single family dwelling units.
RS-2.5 = 72.90 RS-3 = 160.30
RS-6 = 458.50 RM-8 = 14.70
RS-4 = 179.20
A-1 = 242.423
Section 3. Should any portion of Annexation Parcel 2, now "land used"
residential, be changed to a non-residential land use category or rezoned to a non-
residential zoning category, then in that event, the cap of up to 3384 units shall be reduced
by an amount equal to the number of acres so changed multiplied by three and the density
cap shall be that amount for the entire parcel.
Section 4. If any word, phrase, clause, sentence, or section of this ordinance is
for any reason held unconstitutional or invalid, the invalidity thereof shall not affect the
validity of any remaining portions of this ordinance.
Section 5. It is the intention of the City Commission of the City of Parkland,
Florida and it is hereby ordained that the Zoning Map of the City of Parkland be amended
and do hereby direct the Director of Planning to amend the map.

Section 6. All other ordinances in conflict herewith are repealed to the extent of
the conflict.
Section 7. That this ordinance shall be effective immediately upon adoption by
the City Commission of the City of Parkland.
