Home My WebLink About1997-23 Addendum to EMS Agmt with City of Coral Springs RESOLUTION NO. 97-23 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA, AUTHORIZING THE CITY OFFICIALS TO ENTER INTO AN ADDENDUM TO AGREEMENT BETWEEN THE CITY OF PARKLAND AND THE CITY OF CORAL SPRINGS TO PROVIDE EMERGENCY MEDICAL SERVICES FOR THE CITY OF PARKLAND WHEREAS, the City Commission of the City of Parkland, Florida finds and determines that it is in the best interest of the citizens of the City to enter into the attached Addendum to Agreement between the City of Parkland and the City of Coral Springs to provide emergency medical services for the City of Parkland. WHEREAS, the City of Parkland City Commissioners believe that the proposed Addendum to Agreement is in the best interest of the citizens of Parkland; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA: Section 1. That the appropriate City officials are hereby authorized to execute the attached Addendum to Agreement between the City of Parkland, Florida and the City of Coral Springs. Section 2. Section 1. The addendum shall be effective upon the approval of the City Commission of the City of Coral Springs. Section 2. Section 2.01 is amended to read as follows: 2.01 This Agreement is effective October 1, 1997 and shall terminate on September 30, 1998. Thereafter, this Agreement shall be automatically renewable from year to year for a twelve month period beginning October 1st of each calendar year, unless either party terminates the Agreement by providing the other party with ninety (90) calendar days written notice of termination prior to the end of the term. The provision of Emergency Medical Services to PARKLAND is contingent Addendua parkland ... exeOl doc: 39213 (07/01/97) Page 1 of 4 upon PARKLAND continuing to maintain the required Broward County Class 1 Certificate of Public Convenience and Necessity (COPCN) for Advanced Life Support Rescue and Transport. The CON shall name the City of Coral Springs Fire Department, Division of Emergency Medical Services as the provider of the service for PARKLAND. In addition, PARKLAND must maintain any licensing required by county and state. Notwithstanding the above provisions, PARKLAND acknowledges that should PARKLAND not maintain the required COPCN, the Emergency Medical Services required under this Agreement shall not be provided by CITY until the required COPCN is issued by Broward County and all required licensing has been obtained. Sections 3.01 is amended to add the following: No later than August 15th of ,each calendar year, CITY shall advise PARKLAND of the assessment for each category. No later than September 1st of each calendar year, CITY shall provide PARKLAND a notice providing the amount of compensation due CITY for the year, effective October 1st of each calendar year. Section 4.01 is amended to read as follows: PARKLAND, no later than July 1st of each calendar year, shall provide CITY with the calculation of the number of res~dential living units (single family and individual apartments) and the number of commercial, governmental, industrial, institutional and nursing home/assisted living establishments in PARKLAND. For all except residential units, PARKLAND shall also provide the total square footage for the establishments. The calculation for the number of residential units and other designated non-residential establishments shall be based on information filed with the Office of the Broward County Property Appraiser as of January 1 of each year. Severability Should any part, term or provision of this Second Addendum be by the courts decided to be illegal or in conflict with any law of the State, the validity of the remaining portions or provisions shall not be affected thereby.
