J 5f'~ ' A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA, SUPPORTING, AND URGING THE BROWARD COUNTY LEGISLATIVE DELEGATION TO ADOPT THE LOCAL BILL SUBMITIED BY THE CITY OF PARKLAND FOR THE ABOl.:rf.Itm 01f ~~~~~~~B~~.~~=xi~;;:~r UNINCORPORATED PROPERTY INTO THE BOUNDARIES OF THE CITY OF PARKLAND; CONTAINING AN EFFECTIVE DATE. WHEREAS, the City of Parkland has submitted tll'Ie local bills to the Broward County ~.. Legislative Delegation for adoption by the Legislative Delegation; and / WHEREAS, one of the bills provides for the abolition of the West Padd'8ftd Vlat...r ~ ...,L-~1Cl.oC;;1IlC;;lH Dh)Ui~1, a District which has provided no services and presently undertakes no functions of any kind and is therefore in need of abolition; and WHEREAS, the second bill is for the annexation of unincorporated property into the City of Parkland; and / WHEREAS, the proposed annexation relates to territory formerly within the municipal 7-boundaries of the City ofParkland,~..l deannexed in 1989; and ~4-vJ~ WHEREAS, the City of Parkland City Commission believes that the proposed annexation is in the best interests of the citizens of Parkland, the citizens of Broward County, and the property proposed for annexation; and WHEREAS, the City of Parkland is prepared to provide all necessary municipal services and provide proper governing and regulatory authority.for the property proposed to be annexed; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA AS FOLLOWS: Section 1. The City of Parkland does hereby urge the' Broward County Legislative Delegation to approve the local bills submitted by the City of Parkland for abolition of the West Parkland Water Management District and for annexation of unincorporated property into the municipal boundaries of the City of Parkland, The City of Parkland believes that both these local bills would be in the best interests of the citizens of Broward County, t "'t;" Section 2. VII COMMENTS BY THE CITY ATTORNEY ADDED AGENDA ITEM: RESOLUTION (NO. 96-38): Andrew Maurodis said on the issue of annexation, in talking with the attorney for the Broward County Legislative Delegation, they concluded it would be appropriate and advisable for Parkland to adopt this Resolution (No, 96-38) and he read the title of the Resolution, He requested Commission approval and asked that a copy be forwarded to David K. Sigerson, Broward County Legislative Delegation, as soon as possible. The Resolution is asking them to adopt the two local Bills which we have already submitted, the annexation of unincorporated property into the boundaries of the City of Parkland and the abolition of the West Parkland Water Management District. MOTION made by Commissioner Gordon to approve the Resolution, number to be assigned, as state by the City Attorney, Seconded by Commissioner Pugliese, Mayor Pagliara referred to the fourth WHEREAS ""the proposed annexation relates to territory formerly within the municipal boundaries of the City of Parkland, but deannexed in 1989; and" and wanted to know why the City Attorney used the word "but", Mayor Pagliara wanted to know if the West Parkland Water Management District has been abolished through a legislative Act. Andrew Maurodis said no, It was intended to be abolished, Mayor Pagliara wanted to know what authorization North Springs Improvement District has if there is a West Parkland Water Management District there now, Andrew Maurodis said he would have to check the boundaries of both, Mayor Pagliara wanted to know how there can be a District out there called a West Parkland Water Management District if NSID has a Legislative Act saying they have it. They are the District that now controls the roads out there, including Holmberg Road, Maybe they don't control Holmberg Road, PARKLAND CITY COMMISSION MINUTES DECEMBER 4, 1996 PAGE 25 Andrew Maurodis said they do have a Legislative Act giving them the authority, Mayor Pagliara wanted to know how one Act can supersede another Act. Andrew Maurodis does not know and he will have to check. .. ... .. '--... Mayor Pagliara wanted to know the City's position in reference to the roads in that area, Andrew Maurodis asked Mayor Pagliara if he wishes to withdraw the portion referring to West Parkland Water Management District. Mayor Pagliara said take it out. Therefore, on behalf of the City of Parkland, I am fonnally requesting that the Local Bill to abolish the West Parkland Water Management District be withdrawn and that no action be taken on said request. You should note that as relates to the Local Bill for annexation of unincorporated territoryt the City Commission adopted a Resolution urging the Broward County Legislative Delegation to approve said Local Bill. The City will be transmitting the Resolution to you shortly. I would appreciate your making a note with regard to the West Parkland Water Management District and that no further action be taken upon same; alternately, request is made that the annexation bill proposed by the City of Parkland be heard by the Broward County Legislative Delegation at the meeting set for said purpose.
