RESOLUTION NO. 96-11
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF PARKLAND, FLORIDA, PROVIDING FOR THE
RESERVATION OF MONIES FOR THE PAYMENT OF
IMPACT FEES FOR THE COUNTRY'S POINT PLAT,
PARCEL 4 AND PARCEL 10 AND 11 (UNDER THE SIX
PARTY AGREEMENT), FOR THREE PARCELS IN
COUNTRY'S POINT, RESERVING SUFFICIENT MONIES
FOR PAYMENT OF ROAD, PARKS AND RECREATION,
AND SCHOOL IMPACT FEES IN ORDER TO SECURE THE
PAYMENT OF SAID FEES; APPROVING IMPACT FEE
AGREEMENTS FOR ROADS, PARKS AND RECREATION,
AND SCHOOLS FOR SAID PARCELS; CONTAmING AN
EFFECTIVE DATE.
WHEREAS, the City of Parkland owns Parcel 4 and Parcel 10 and 11 (as described in the
Agreement Among Broward County, The Kennedy Group, Mecca Farms, Inc., Oriole Homes
Corporation, Pine Tree Water Control District, and the City of Parkland Relating to The Realignment
of Hillsboro Boulevard) in the Country's Point Plat; and
WHEREAS, on February 6, 1996, Broward County agreed to amend the note on the face
of the Country's Point Plat with respect to said parcels; and
WHEREAS, as a result of said amendment, the City of Parkland is required to pay for road
impact fees in the amount of $7,797.49 for Parcel 4, $256.24 for Parcels 10 and 11; with respect to
Parcels 10 and II, the City is also required to bond for $4,060.00 in park fees and $25,660.00 for
school impact fees for Parcels 10 and 11; and
WHEREAS, because the City of Parkland is a municipality and may not place a lien on its
property, it is entering into the attached impact fee agreements with Broward County to assure
payment of said fees; and
WHEREAS, as part of its obligation under said agreements, the City must reserve an
amount sufficient to pay said impact fees; and
WHEREAS, the City wishes to comply with the obligations set forth therein and to
implement the attached impact fee agreements to assure proper payment of all impact fees due as
a result of the note amendment;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF PARKLAND, FLORIDA AS FOLLOWS:
Section 1.
The City of Parkland does hereby affirm the WHEREAS clauses stated above.
Section 2. The City of Parkland does hereby reserve the amounts set forth above for
payment of the necessary impact fees as stated above for the parcels in Country's Point herein
identified, and shall undertake all steps necessary requested by Broward County to comply with
Broward County requirements for the payment of impact fees for said parcels and to assure that said
fees are paid as specified above.
Section 3. The City approves and authorizes the Mayor and proper City officials to
execute and implement the attached impact fee agreements.
Section 4.
This Resolution shall become effective upon adoption.

This is an Agreement, made and entered into by and between: BROW ARD COUNTY, a
political subdivision of the State of Florida, hereinafter referred to as "COUNTY",
AND
CITY OF PARKLAND, its successors and assigns, hereinafter referred to as
"DEVELOPER".
WHEREAS, Chapter 5, Article IX, Broward County Code of Ordinances requires that the
Regional Transportation Network be adequate to serve the reasonably projected needs of proposed
developments; and
WHEREAS, the DEVELOPER seeks to satisfy this requirement with respect to a portion of
the proposed development of the Country's Point Plat, Plat No. 025-UP-82 for which a plat note
amendment has been approved, hereinafter referred to as PLAT, which note amendment was
approved by the Board of County Commissioners of Broward County on February 6, 1996, by
entering into this Road Impact Agreement for the payment of an amount of money to the COUNTY
to be utilized to meet the transportation needs of future residents or users of the area covered by the
Plat; and
WHEREAS, a description of the portion of platted area covered by the note change and
ov/ned by the Cit'j is attached hereto as Exhibit "A" and made a part hereof;
NOW THEREFORE, IN CONSIDERATION of the mutual terms, conditions, promises,
covenants and payments hereinafter set forth, COUNTY and DEVELOPER agree as follows:
1. The DEVELOPER agrees to pay to COUNTY the sum of $256.24 for dwelling units
as provided below and in accordance with paragraph 5. This sum is based upon
approval of development within the plat for:
(a) 10 single family unit(s) at $25.62 per unit; and/or
(b)
town house unit(s) at $
per unit; and/or
(c)

Upon the date of issuance of a building permit for the construction or erection of a
residential building, DEVELOPER shall pay an amount equal to the nwnber of units
to be constructed, multiplied by the applicable unit fee as set forth above and as
adjusted by paragraph 3.
2. The DEVELOPER agrees to pay to COUNTY the swn of $7,797.49 for
nonresidential buildings as provided below and in accordance with paragraph 5. This
swn is based upon approval of development within the plat for:

Upon the date of issuance of building permit for the construction or erection of a
nonresidential building, DEVELOPER shall pay an amount equal to the nwnber of
square feet of said building to be constructed if fees have been assessed above on a
square foot basis, or the total acreage within the PLAT that COUNTY determines is
necessary to support the nonresidential building if fees are assessed above on an
acreage basis, multiplied by the applicable fee (per square foot/acre) as set forth
above and as adjusted by paragraph 3.
3. The outstanding balance and the applicable fees required under paragraph 1 andlor
paragraph 2 above have been computed as of the date of plat approval and shall be
continuously reduced or increased from said date based upon the State of Florida
Department of Transportation Construction Index.
"Outstanding balance" shall mean the cumulative swn of the fees that DEVELOPER
has agreed to pay under paragraph 1 and paragraph 2 as adjusted by paragraph 3 and
as reduced by payments made by DEVELOPER.

(a)
The DEVELOPER is a governmental agency and is not required to provide
security for the payment of applicable fees. In the event DEVELOPER
conveys the property described in Exhibit "A" to another party prior to the
date when payment of fees are due, DEVELOPER shall require such party
to enter into a road impact agreement acceptable to COUNTY securing the
outstanding balance due in a form acceptable to COUNTY. In the event
applicable fees under this Agreement become due from DEVELOPER,
DEVELOPER funds will be made available to pay such sums.
(b) This Agreement shall be recorded in the Official Records ofBroward County
as notice to purchasers from the DEVELOPER of the obligation to enter into
. a road impact fee agreement with COUNTY and to pay such fees in
accordance with the agreement. In no event shall the recording of this
Agreement act as a lien against the property described in Exhibit "A" during
the time such property is owned by DEVELOPER.
(c) Execution of this Agreement by a governmental agency as DEVELOPER
shall not act as a waiver of the governmental agency's right to apply and
receive a waiver of payment of such fees pursuant to the provisions of
Section 5-183 of the Broward County Code of Ordinances.

In the event that the DEVELOPER pays or a portion of the outstandmg balance,
or COUNTY-obtains all or a portion of the outstanding balance by recourse against
the required security as provided under paragraph 4, and the PLA T's approval
subsequently expires due to DEVELOPER's failure to record the PLAT within the
required time period under Broward County Land Development Code, COUNTY
shall refund to DEVELOPER the total amount of fees paid and/or collected, less
costs incurred under paragraph 4. If the parties hereto have entered into an
agreement for building permits prior to plat recordation, no refund may be obtained
under this paragraph until DEVELOPER has met all terms and conditions of said
agreement, including, but not limited to, the requirement to remove structures.
7. The parties agree that any monies paid to the COUNTY pursuant to this Agreement
shall only be used for the following purposes:

(a) To provide a safe and adequate regional road system to serve the future
residents or users of the property within the Plat; or
(b) If the COUNTY has a plat to provide safe and adequate mass transit to serve
the future residents or users of the property within the Plat and the COUNTY
determines such transit improvements will provide substantial benefit to the
platted property by providing alternative transportation opportunities or
alleviating congestion on overcapacity roads for which fees have been
charged, then the monies paid to COUNTY pW'Suant to this Agreement may
be used for mass transit purposes.
8. Nothing herein shall be construed as precluding the COUNTY from requiring that
building permits or certificates of occupancy not be issued until fees are paid as
required by the conditions of approval of the PLAT, or shall otherwise waive or
affect the right of COUNTY to otherwise require DEVELOPER to comply with the
conditions of plat approval or this Agreement by any remedy provided by law or
equity.
IN WI1NESS WHEREOF, the parties have made and executea this Agreement on the
respective dates under each signature: BROW ARD COUNTY through its BOARD OF COUNTY
COMMISSIONERS, signing by and through its Chairman, authorized to exercise same by Board

This is an Aanem.eat between BROWARD COUNTY, a political subdivision of the State of
Florida, hereinafter referred to as "COUNlYll, throuah its Board of Couoty Commissioners,

CITY OF PARKLAND, a Florida municipal corporatiOD, hereioafter referred to as "CITY",
through its City Counci~

WIIEREAS, CITY's Plat, known II The Parklaod Municipal Center, hereinafter referred to
as the "PLAT", was approved by the Board ofCouoty Cnmmissiooers ofBroward County 00 August
6, 1996, and is described in Exhibit "A", attached hereto and incorporated herein; and
WHEREAs, the PLAT was approved subject to certaia cooditioos to ensure the protection
of the public health and.safety, aod one of the conditioos imposed at the time of PLAT approval was
the cODStlUction of certain road improvements;
NOW THEREFORE, in CODSideratiOll of the mutual terms, conditions, promises, and
paymeats hereinafter set fonh, COUNTY and CITY agree as follows:

(a)
The DEVELOPER is a governmental agency and is not required to provide
security for the payment of applicable fees. In the event DEVELOPER
conveys the property described in Exhibit "A" to another party prior to the
date when payment of fees .are due, DEVELOPER shall require such party
to enter into a road impact agreement acceptable to COUNTY securingJthe
outstanding balance due in a form acceptable to COUNTY. In the event
applicable fees under this Agreement become due from DEVELOPER,
DEVELOPER funds will be made available to pay such sums.
(b) This Agreement shall be recorded in the Official Records ofBroward County
as notice to purchasers from the DEVELOPER of the obligation to enter into
a road impact fee agreement with. COUNTY and to pay such fees in
accordance with the agreement. In no event sh8.l1 the recording. of this
Agreement act as a lien against the property described in Exhibit'~ A" dunng
the time such property is owned by DEVELOPER.
(c) Execution of this Agreement by a governmental agency as DEVELOPER
shall not act as a waiver of the governmental agency's right to apply and
receive a waiver of payment of such fees pursuant to the provisions of
Section 5-183 of the BrowardCounty Code of Ordinances.

6. In the event that the DEVELOPER pays all or 1 g~rtion of the outstanding balance,
or COUNTY obtains all or a portion of the outstanding balance by recourse against
the required security as provided under paragraph 4, and the PLAT's approval
subsequently expires due to DEVELOPER's failure to record the PLAT within the
required time period under Broward County Land Development Code, COUNTY
shall refund to DEVELOPER the total amount of fees paid and/or collected, less
costs incurred under paragraph 4. If the parties hereto have entered into an
agreement for building permits prior to plat recordation, no refund may be obtained
under this paragraph until DEVELOPER has met all terms and conditions of said
agreement, including, but not limited to, the requirement to remove structures.
7. The parties agree that any monies paid to the COUNTY pursuant to this Agreement
shall only be used for the following purposes:

subdivision of the State of Florida, its successors and assigns
hereinafter referred to as "COUNTY";

residential, Parcels 1 and 2 are restricted to commercial use, Parcel 3 is
restricted to 15,760 square feet of commercial use, Parcel 4 is restricted to 18,504
square feet of commercial use and Parcels 10 and 11 are restricted to 10 single
family dwelling units, as such parcels are identified in the Agreement between
Broward County, The Kennedy Group, Mecca farms, Inc., Oriole Homes
corporation, Pine Tree Water Control District, and the City of Parkland, as
recorded in Official Records Book 16700, Page 826 of the Public Records of
Broward County, Florida. This amended note shall not abrogate the right of the
City of Parkland to enforce its Land Development code, and thus permit a lesser
