HomeMy WebLinkAbout1996-06 Opposing Further Leglislation for further Property Rights-Infringement on Zoning and Land Use Auth RESOLUTI,ONNO. 96 - 06 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PARltLAND, FLO,RIDA OPPOSING ANY FURTHER LEGISLATION WHETHER BY STATUTE OR IN THE STATE CONSTITUTION PROVIDING FOR FURTHER PROPERTY RIGHTS PROTECTION WHICH INFRINGES UPON ZONING AND LAND USE Al1TBORITY OF LOCAL GOVERNMENT; CONTAINING AN EFFECTIVE DATE. WHEREAS, the Florida Legislature maybe asked to review additional legislation which would further erode the ability of the cities to regulate land use and zoning matters; and WHEREAS, under the guise of property rights protection" these regulations whether in State Statutes or in the Constitution" will greatly inhibit the rights of local governments to control the quality of life to the benefit of all citizens and will provide undue advantage and benefit to developers. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE C,ITY OF PARltLAND, FLORIDA AS FOLLOWS: Section 1. The City of Parkland does hereby urge the ,Florida Legislature to defeat any legislation which further strengthens the property rights provisions already drafted in the Burt Harris Property Rights Protection Act and to defeat any attempt to include any of the provisions therein in said Florida Constitution. Further, the City of Parkland urges the State Legislature to revise, modify, or repeal the Burt Harris Property Rights Protection Act as an unduly severe interference upon the ability of local governments to regulate land development actions at the local level. Section 2. The City Clerk is hereby authorized to provide copies of this Resolution to the Broward Legislative Delegation and all other parties deemed appropriate. Section 3. upon adoption. This Resolution shall become effective PASSED AND ADOPTED THIS 6 DAY OF MARCH , 1996. The City Commission also wished to make known the impracticality of the provision included in Senate Joint Resolution 762, section 17, (b) "All these issues must be detennined by jury trial..... The Commission is concerned that this language dictates it must be detennined by a jury trial thereby eliminating the opportunity to settle without going to court.
