Recertification of Comp PlanRESOLUTION 94-31 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA TRANSMITTING TO THE BROWARD COUNTY PLANNING COUNCIL AMENDMENTS TO THE FUTURE LAND USE MAP OF THE ADOPTED COMPREHENSIVE PLAN OF THE CITY OF PARKLAND, REQUESTING RECERTIFICATION OF THE FUTURE LAND USE MAP, THERETO BY THE BROWARD PLANNING COUNCIL; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Future Comprehensive Plan must Planning Council before it Parkland; and Land Use Map of the City of Parkland be recertified by the Broward County can be the effective map for the City of WHEREAS, on October 21, 1992, recertification was granted b Broward County Planning Council; and y WHEREAS, the City of Parkland has since adopted amendments the Future Land Use Ma to p of the Comprehensive Plan which are attached hereto as Exhibit A; and WHEREAS, the City of Parkland seeks recertification of the ma with the amendments attached hereto as Exhibit A; P and WHEREAS, the Department of Community y Affairs has found the Future Land Use Map as amended to be in compliance as of May 6, 1994; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION CITY OF PARKLAND, FLORIDA AS FOLLOWS: OF THE Resolution 94-31 Page 2 Section 1. The recitals contained in the preamble to this Resolution are incorporated by reference herein. Section 2. The City hereby transmits The Future Land Use Map of the Comprehensive Plan to the Broward County Planning Council, and requests recertification of the Future Land Use Map as amended. Section 3. '4g";;7 S PAGgRA, MAYOR PART OF RESOL. 94-31 92039229 ORDINANCE NO. 91 - 40 AN ORDINANCE OF THE CITY OF PARKLAND, FLORIDA ANNEXING CERTAIN LANDS TO THE CITY OF PARKLAND, FLORIDA PURSUANT TO FLORIDA STATUTES, CHAPTER 171 WHEREAS, the owner of real property in an unincorporated area of Broward County, which real property is contiguous to the City of Parkland, Florida, has petitioned the governing body of the City of Parkland that said property be annexed to the City, said real property being described as follows, to wit: Attached "Exhibit A" WHEREAS, the Petition of the owner is made pursuant to Florida Statutes, chapter 171 (said Petition is attached as Exhibit "B"); and WHEREAS, the City of Parkland has reviewed the Petition and finds it acceptable in all respects; and WHEREAS, the requirements of the Florida Statutes, Chapter 171, for voluntary annexation have been met; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA, AS FOLLOWS: Section 1. All preconditions for annexation have been met and all requirements of Chapter 171 and findings of fact as required therein are hereby made. Section 2. That the City Commission has determined that the petition bears the signatures of the owner of the property in the area proposed to be annexed to the City of Parkland. Section 4. That the following real property_is hereby annexed to the City of Parkland, Florida, and the boundary lines of the City ,are hereby redefined to include said property within the boundary lines of the City and shall be subject to all.laws and regulations of the City. "EXHIBIT A" Section 5. That this Ordinance shall be passed and take effect immediately upon adoption. Section 6. That the City Clerk is hereby authorized and directed to file a certified copy of this Ordinance with the County Administrator's Office of Broward County, Florida, with the Department of State, Tallahassee, Florida, with the Property Appraiser, with the Board of County Commissioners of Broward County and the Clerk of the Circuit Court. Section 7. This property shall be preserved by the City as a park. The City shall provide any water and sewer services as needed. Section 8. That this Ordinance was adopted after a public hearing was had upon the subject matter hereof, and notice of hearing was published as required by law; which public hearing was held on the 22nd day of January, 1992. Said lands situate, lying and being in Broward County, Florida. PART OF RESOL. 94-31 ORDINANCE NO. 93-17 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA, AMENDING THE FUTURE LAND USE MAP OF THE CITY OF PARKLAND AS DESIGNATED IN EXHIBIT A; CONTAINING A PROVISION FOR AMENDING THE FUTURE LAND USE MAP; CONTAINING A SEVERABILITY CLAUSE; CONTAINING AN EFFECTIVE DATE;CASE NO. 04 -SC -93 WHEREAS, the City Commission of the City of Parkland has received an application for land use amendments of -Castle Rock and Parkland Center from Commercial land use designation to Residential land use of. R-6. WHEREAS, the City Commission of the City of Parkland finds it in the best interest of the City to amend the Future Land Use Map as designated in Exhibit A; and WHEREAS, the Planning and Zoning Board of the City of Parkland has reviewed said petition as required by Florida Statutes and recommends approval by a 7-0 vote; and WHEREAS, the City Commission of the City of Parkland has held duly advertised public hearings for the above mentioned petition; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA AS FOLLOWS: Section 1. The Future Land Use Map of the City of Parkland shall be amended to contain the Future Land Use Designations as shown on the attachment Exhibit A. Section 2. If any word, phrase, 'clause, sentence, or section of this ordinance is for any reason held unconstitutional or invalid, the invalidity thereof shall not affect the validity of any remaining portions of this ordinance. Section 3. It is the intention of the City Commission of the City of Parkland, Florida and it is hereby ordained that the Future Land Use Map of the City of Parkland be amended and do hereby direct the Director of Planning to amend the Future Land Use Map. The effective date of this plan amendment shall• be the date a final order is issued by the Department of Community Affairs or Administration Commission finding the amendment in compliance in accordance with Section 163.3184, Florida Statutes, whichever occurs earlier. No development orders, development permits, or land uses dependent on this amendment may be issued or commence before it has become effective. If a final order of noncompliance is issued by the Administration Commission, this amendment may nevertheless be made effective status, a copy of which resolutions shall be sent to the Department of Community Affairs, Bureau of Local Planning, 2740 Centerview Drive, Tallahassee, Florida 32399-2100.
