HomeMy WebLinkAbout1994-08 Replat of Cypress Cay (Parkland Lakes) Tracts E, EIRESOLUTION 94-8 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA FOR PLAT APPROVAL OF CYPRESS CAY, A REPLAT OF TRACTS E & E-1 OF THE PARKLAND LAKES PLANNED UNIT DEVELOPMENT FOR 106 SINGLE FAMILY UNITS; CASE NO. 08 -PT -93 WHEREAS, at a regular meeting of the City Commission, a Public •Hearing was held to hear testimony for and against the petition of Transeastern Properties of South Florida, Inc., requesting approval of Cypress Cay, a replat of Tracts E and E-1 of the Parkland Lakes Planned Unit Development for the development of 106 single family units; and WHEREAS, the petition was reviewed by the Planning and Zoning Board who voted 6-0 to recommend approval; and WHEREAS, the proposed plat is found to be in conformance with all applicable subdivision regulations and is in compliance with current concurrency requirements as well as land development regulations. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Parkland, Florida that; The Cypress Cay plat is approved with the following condition: 1. This approval is based on the plat entitled Cypress Cay prepared by Carnahan -Proctor and Associates, Inc. dated received by the City of Parkland December 28, 1993. SUSAN ARMSTRONG, CITY CLERK f. t lao `71-g 94-384650 08-04-94 AGREEMENT TO PLACE A NOTATION ON PLAT BETWEEN BROWARD COUNTY AND TRANSEASTERN PROPERTIES OF SOUTH FLORIDA, INC. iO3:011PM THIS IS an AGREEMENT between BROWARD COUNTY, a political subdivision of the State of Florida, its successors and assigns hereinafter referred to as "COUNTY"; AND TRANSEASTERN PROPERTIES OF SOUTH FLORIDA, INC., its successors and assigns, hereinafter referred to as "DEVELOPER." WHEREAS, DEVELOPER is the owner of Tracts D, T, and the North half of Tract G, as shown on the Plat of PARKLAND LAKES P.U.D., Plat No. 045 -CP -79, which plat was recorded in Plat Book 102, Page 44, in the Public Records of Broward County on May 15, 1979; and WHEREAS, the PARKLAND LAKES P.U.D. Plat presently does not contain a notation on the face of the plat; and WHEREAS, DEVELOPER has requested that a notation be placed on the face of the Plat in order to define the maximum development level proposed for Tracts D, T, and the North half of Tract G of Parkland Lakes, P.U.D.;and WHEREAS, the COUNTY has no objection to placing said notation on the face of the plat, and the Board of County Commissioners has approved such a notation at its meeting on June 21, 1994; Approved BCC Submitted By 1 ?RETURN TO DOCUi :ca •: N • c-)• • L L%742 NT CONTROL(7_ C' n �i NOW, THEREFORE, in consideration of the mutual terms, conditions and promises hereinafter set forth, the COUNTY and DEVELOPER agree as follows: 1. The above recitals and representations are true and correct. 2. COUNTY and DEVELOPER hereby agree that by the recording of this document a notation .is hereby placed on Tracts D, T and the North half of Tract G of the PARKLAND LAKES P.U.D. Plat to read as follows: Development on Tracts D and T, Parkland Lakes P.U.D., as recorded in Plat Book 102, Page 44, in the Public Records of Broward County, shall be restricted to commercial not to exceed 44,050 square feet of building space or to not more than 78 townhouse units or 78 garden apartments. Development on the North half of Tract G, Parkland Lakes, as recorded in Plat Book 102, Page 44, in the Public Records of Broward County, shall be restricted to commercial, not to exceed 57,150 square feet of building space. This note is required by Chapter 5, Article IX, Broward County Code of Ordinances and may be amended by approval of the Broward County Board of County Commissioners. The notation and any amendments thereto are solely indicating the approved development level for Tracts D, T, and the North half of Tract G, Parkland Lakes, P.U.D., and do not operate as a restriction in favor of any property owner including an owner or owners of property within Parkland Lakes who took title to the property with reference to the Parkland Lakes, P.U.D. plat. 3. COUNTY and DEVELOPER agree that the notation, set forth in Paragraph 2 above, on the face of the PARKLAND LAKES P.U.D. Plat shall clarify and limit the use of Tracts D, T, and the North half of Tract G of PARKLAND LAKES P.U.D. Plat property. 4. This Agreement shall be recorded in the Public Records of Broward County, Florida, to evidence the agreements and representations of the parties as set forth herein. 2 IN WITNESS WHEREOF, the COUNTY and DEVELOPER have made and executed this Agreement on the respective dates under each signature: BROWARD COUNTY through its Board of County Commissioners, acting by and through its Chairman or Vice Chairman, authorized to execute same; and Transeastern Properties of South Florida, Inc., acting by and through its President, Arthur J. Falcone, duly authorized to execute same.
