HomeMy WebLinkAbout1994-02 Ranches Drainage Assessment (prev 93-16 was renumbered)94-201976 T#OO1 04-26-94 09:22AM RESOLUTION NO. 94-02 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PARKLAND EVIDENCING ITS INTENT TO PROVIDE FOR A MAJOR PUBLIC IMPROVEMENT PROJECT, LOCATED IN THE AREA GENERALLY KNOWN AS THE RANCHES, ALL INCLUSIVE IN THE CITY OF PARKLAND, BEING DRAINAGE IMPROVEMENTS SERVING THE LOTS WITHIN THE RANCHES AND ESTABLISHING THE COSTS AND EXPENSES THEREOF; PROVIDING FOR ALL COSTS AND EXPENSES TO BE ASSESSED AGAINST THE PROPERTIES ON AN ACREAGE BASIS; PROVIDING FOR PAYMENT AND TERMS AND THE INTEREST RATE TO BE CHARGED WITH RESPECT TO SUCH ASSESSMENTS; THE PERCENTAGE OF THE ASSESSMENT THAT MUST BE PAID AT THE TIME OF ASSESSMENT AND FOR SEMI-ANNUAL PAYMENTS THEREAFTER; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, there are certain properties located within the City of Parkland comprising the properties within the area indicated in Section 1; and WHEREAS, it is the intent of the City drainage improvements for lots; and WHEREAS, the lots in question will be the improvements, WHEREAS, the City has undertaken the subject improvement and assessment subject to the authority of Chapter 170, Florida Statutes, and its home rule powers through Chapter 166, Florida Statutes, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA: Commission to provide for specifically benefited by Section 1. That the City Commission does hereby declare the necessity for drainage improvements for all lands to be described in the assessment plat hereinafter provided for and generally located within the areas described as follows: -(Public road rights -of -ways, public roadway easements, and public roadway ingress and egress easements are excluded) - B.B.B. Ranches (unrecorded plat) in Section 3, Township 48, Range 41 within the City of Parkland, Broward County, Florida. Section 2. The improvements located in the area described in Section 1 above are for drainage purposes. The general description of the project is as follows: Drainage improvements including the following: - Excavation and disposal of approximately three feet of silt and debris from approximately 26,000 LF of canals and culverts; and - Replacement of existing headwall (on east side of pump), 22,500 gpm pump(approximate), over- 8L809d0S03319 Resolution No. 94-02 Page 3 flow weir, discharge pipe, flap gate, and structure (housing the power unit and diesel tank); and - Repair of the power unit and diesel tank for drainage purposes; and - Installation of a temporary silt barrier for drainage; and - Street sweeping, road repairs (attributable to this project), and a one time spraying of the canals; and - Temporary electric power and pump rental for project. - Other necessary actions attendant to the above. Section 3. The estimated cost (including administrative, engi- neering and legal expenses) of the project is $151,936. Section 4. That due to the nature of the drainage improvements, all of which are local improvements solely for the special benefit of the lots contained within the area described in Section 1 above; 100 percent of the costs of the above-described project shall be assessed against said lots and lands in the area described in Section 1 above, said assessments to be made on an acreage basis. Section 5. That the assessments when established shall require twenty (20%) percent of the total lot assessment from the project to be paid within a period of 60 days from the date of final assessment and the balance to be paid in four (4) regular successive semi-annual payments of the principal and accrued interest, which interest shall be established at eight (8%) percent per annum. Section 6. That all of the costs set out in Section 3 for the project described in Section 2 above, shall be in the special assess- ments which shall be levied against all lots or lands adjoining and contiguous or bounding and abutting upon such improvements or special- ly benefited thereby (as generally described in Section 1) and further designated by the assessment plat to be hereinafter provided for by the City. The costs of the project described herein shall be assessed at 100% to said lots and properties. Resolution No. 94-02 Page 4 Section 7. That the City Commission will pass such other resolu- tions, provide proper notices and take such other steps as may be necessary or required to declare the special assessments, and provide for the equalizing board hearings.
