1993-02 Considering Amendment to Zoning & Land Dev Code to Provide for a RS-2.5 RE: Pending ApplicationsRESOLUTION 93 - 2 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PARKLAND DECLARING THAT THE CITY OF PARKLAND WILL BE CONSIDERING AN AMENDMENT TO ITS ZONING AND LAND DEVELOPMENT CODE TO PROVIDE FOR A ZONING CATEGORY OF RS- 2.5 AND STATING THAT THE CITY COMMISSION OF THE CITY OF PARKLAND IN REVIEWING ANY PROPOSED OR PENDING REZONING APPLICATION IN AREAS WITH A LAND USE DESIGNATION OF 2.5 UNITS TO THE ACRE OR 3 UNITS TO THE ACRE MAY BE SUBJECT TO SAID ZONING CATEGORY, PROVIDED THAT THE CITY COMMISSION FORMALLY ADOPTS A RS -2.5 ZONING CATEGORY WITHIN NINETY (90) DAYS OF THE DATE OF THIS RESOLUTION WHEREAS, the City Commission of the City of Parkland has deter- mined that consideration of a zoning category of RS -2.5 is in its best interests and would more properly suit many parcels of property which have a land use designation of 2.5 units or 3 units per acre; and WHEREAS, the City staff has drafted an amendment to the Zoning and Land Development Code to provide for such an RS -2.5 category; and WHEREAS, the City of Parkland Planning and Zoning Board will shortly be reviewing said amendment as a local planning agency; and WHEREAS, the City Commission will expeditiously make a final decision on adopting such a Zoning and Land Development Code amend- ment, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF PARKLAND, FLORIDA: Section 1. The City Commission declares that an amendment to the Zoning and Land Development Code is presently in progress. All property owners, with property in a land use category of 3 units per acre or 2.5 units per acre, are hereby placed on the notice that the City Commission will, when considering any rezoning application during the next ninety (90) days, either abate any consideration on said zoning application until the conclusion of said ninety (90) day period or the adoption of a RS- 2.5 zoning category, whichever occurs earlier or, consider such a rezoning petition with the understanding that the City will retain the option of amending any zoning application (prior to adoption of any rezoning petition) which seeks a more intense zoning category by reducing it to RS -2.5 if the City Commission deems 01.13.93 Resolution No. 93 - 2 Page 2 it in the best interests of the City of Parkland and more appropriate for the area to be rezoned. Section 2. The provisions of this Resolution shall be in effect for a period of ninety (90) days. During said period, all applicants for rezoning in a land use category of 3 units per acre or 2.5 units per acre, shall be subject to this statement that an amendment is in progress and that any such rezoning application may be subject to revision to the RS -2.5 zoning category as set forth herein.
