TO PROCESS THE PARKLAND CENTER PLAT WITHOUT REQUIRING DEVELOPMENT OF REGIONAL IMPACT REVIEW WHEREAS, the City Commission of the City of Parkland finds and determines that it is in the best interests of the citizens of the City to enter into the attached Agreement with Mecca Farms, Inc.; NOW. SUSAN ARMSTRONG, CITY�BLERK SA PAGLIARA YOR FEE ITEM RETURN TO FRONT RECORDING c0 C„.0 Res. 91-29 DEVELOPER'S AGREEMENT This Developer's Agreement is entered into by and between the CITY OF PARKLAND (PARKLAND) and MECCA FARMS, INC., its successors and assigns (MECCA) as follows: WHEREAS, MECCA owns parcels of property more particularly described on composite Exhibit A (the Property); and WHEREAS, MECCA is attempting to plat the remaining portion of that Property which has not been platted to permit development of the Property; and WHEREAS, the Property is located within the municipal bound- aries of the City; and WHEREAS, MECCA has platted the Property and has developed the infrastrastructure to serve the Property to be shared by all parts of the Property; and WHEREAS, the City has concerns that part of the Property or the entire parcel thereof as platted and proposed to be platted may constitute a development of regional impact; and WHEREAS, the parties wish to permit MECCA to plat the remain- ing parcel of Property without being required to wait for a binding letter of interpretation from the Department of Community Affairs; and ; and WHEREAS, the parties also understand and agree that the City is desirous of assuring that if the development approaches any threshhold for a development of regional impact that the appropri- ate development of regional impact review be conducted or that a binding letter be obtained indicating that the development is not a development of regional impact; and WHEREAS, the parties wish this Agreement to be binding upon themselves and all successors and assigns of the Property and any party or entity that owns any part of the Property in the future; and WHEREAS, the parties understand that nothing contained herein shall be construed so as to limit any rights or obligations of the City with regard to City or State land development regulations or development of regional impact regulations and the City's right to request a binding letter from the Department of Community Affairs at any time or to require compliance with Section 380.06, Florida Statutes, NOW, THEREFORE, BE IT AGREED BY AND BETWEEN THE PARTIES AS FOLLOWS: SECTION 1. That the above recitations are true and correct and are made a binding part of this Agreement. SECTION 2. That the City agrees to process the Parkland Center Plat, which is the subject of Plat Application No. 001-PT-91,in the City of Parkland, without requiring development of regional impact review or the receipt of a binding letter of interpretation that the subject plat does not constitute a develop- ment of regional impact based upon the covenants contained herein. SECTION 3. Should the cumulative development contained on the Property reach, or propose to reach by virtue of the approval of any site plan or building permits or other application for develop- ment permit (as defined in Chapter 380.04, Florida Statutes) 80% of the threshhold contained in Guidelines and Standards for Develop- ments of Regional Impact contained in Section 380.0651 Florida Statutes (1989) as they exist today or as may be amended from time to time or established by the State of Florida, then in that event, any party owning any portion of the Property upon which an application for development permit shall cause 80% of these threshholds to be reached or exceeded, shall be required to apply CO a•: 0 CO Lf, Res. 91-29 to the Department of Community Affairs for a binding letter of interpretation (Binding Letter) that the development either indi- vidually, or as part of an aggregation with other development on the property does not constitute a development of regional impact, or undergo development of regional impact review. Any such request for a Binding Letter shall include a copy of this Agreement. No development permit shall be issued for said property until receipt of said Binding Letter. Further, if the Binding Letter indicates that any part of the Property is a Development of Regional Impact, no development permit shall be issued until the project has under- gone the necessary review required by Section 380.06, Florida Statutes and received the necessary approvals. Receipt of a Binding Letter or development of regional impact review if required shall be a precondition to the City's reviewing any application for development permit which should cause the Property, judged on a cumulative basis, to reach the 80% threshhold described herein. SECTION 4. Should any applicant for a development permit fail to apply for the Binding Letter as described above or seek develop- ment of regional impact review when required herein, the City shall be under no obligation to process the application for development permit or, shall request said binding letter from the Department of Community Affairs prior to processing any application for develop- ment permit. Receipt of a Binding Letter pursuant to this Agreement shall not prejudice the City's right to request other Binding Letters and delay processing a development permit until said additional Binding Leters are' received if the City believes it appropriate to do so under Section 380.06, Florida Statutes or other a4plicable State regulations. SECTION 5. Where there is a possibility that, as a result of aggregation with other development on the property, an application for development permit shall cause the amount of development to exceed 80% of any threshhold contained in Section 380.0651, Florida Statutes (1989), or later established by the State of Florida, to be reached or exceeded, then in that event, the owner who must apply for a Binding Letter as required above shall be obligated to furnish the necessary information to DCA and copies of all said information to the City. SECTION 6. The parties understand and agree that this docu- ment shall be liberally construed in favor of the City to assure that it shall be able to require that any potential development of regional impact be processed in accordance with Chapter 380.06 of the Florida Statutes. Nothing contained herein shall limit in any way the authority of the City to request a Binding Letter from the Department of Community Affairs either before or after the binding letter contemplated herein is obtained or to delay the processing of any application for development permit if the City chooses to request a Binding Letter with respect to any part of the Property. SECTION 7. The effective date of this document shall be date upon which the last party hereto has affixed its signature. SECTION 8. This is the entire agreement and no amendment hereof shall be permitted except through a written document signed by the parties hereto. SECTION 9. This agreement shall be recorded in the Public Records of Broward County and constitute a binding obligation on the Property and shall run with the Property and shall bind MECCA FARMS, INC., its successors and assigns, and shall bind all future owners of the Property and or any parties with an ownership inter- est in said Property.
