ACCEPTING A BILL OF SALE EXECUTED BY FLORIDA NATIONAL PROPERTIES ON DECEMBER 4. 1990 FOR AN ASPHALT BIKE PATH ON RIVERSIDE DRIVE FROM 1HE SAWGRASS EXPRESSWAY TO HOLMBERG ROAD WHEREAS. the City Commission believes it is in the best interests of the City of Parkland to accept the attached Bill of Sale for the transfer of an asphalt bike path on Riverside Drive from the Sawgrass Expressway to Holmberg Road to the City of Parkland: NOW. THEREFORE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF PARKLAND. FLORIDA AS FOLLOWS: Section 1. The attached Bill of Sale from Florida National Properties to the City of Parkland. dated December 4. 1990. is hereby approved and accepted by the City of Parkland. CITY LERK BILL OF SALE KNOW ALL MEN BY THESE PRESENTS, that FLORIDA NATIONAL PROPERTIES, INC., a Florida corporation, party of the first part, for and in consideration of the sum of Ten and No/IOO ($10.00) Dollars, lawful money of the United States, to it paid by the CITY OF PARKLAND, a municipal corporation organized and existing under the laws of the State of Florida, party of the second part, receipt of which is hereby acknowledged, has granted, bargained, sold, transferred and delivered, and by these presents does grant, bargain, sell, transfer and deliver unto the party of the second part, its successors and assigns, those certain asphal t bikepath improvements (" Improvements" ) described as follows: The asphal t bikepath wi thin that certain Public Right-of-Way as shown on Plan Sheets 1 through 11, dated November 29, 1989, Job No. 8507011, as prepared by Carnahan & Associates, Inc., Engineers, and as legally described in that Right-of-Way Deed from Florida National Properties, Inc. to the City of Parkland, dated September 17, 1986 and recorded in Official Records Book 13792, at Page 658, of the Public Records of Broward County, Florida. TO HAVE AND TO HOLD the same unto the said party of the second part, its successors and assigns, forever. AND, it does for itself, and its successors and assigns, covenant to and with the party of the second part, its successors and assigns, that it guarantees said Improvements against defects in workmanship and materials for a period of one (1) year from the date of acceptance by the City Commission; that it is the lawful owner of said Improvements; that all bills for the construction of the Improvements have been paid in full; that they are free from encumbrances; that it has good right to sell said Improvements, and that it will warrant and defend the sale of said Improvements hereby made, unto the said party of the second part, its successors and assigns, against the lawful claims and demands of all persons whomsoever.
